1. Overview

This website is operated by MISTYLUMA ALEKSANDRA LUBOCH. Throughout the site, the terms “we”, “us” and “our” refer to Mistyluma.

By visiting our website and/or purchasing a product from us, you agree to these Terms of Service. These Terms apply to all users of the website, including customers and visitors.

Please read these Terms carefully before placing an order.

3. Products

Mistyluma offers book-related products, including custom-made dust jackets and other bookish accessories.

Please note that books are not included with dust jackets unless explicitly stated otherwise in the product description.

Product photographs are intended to represent the products as accurately as possible. However, colours may vary slightly depending on screen settings, lighting, printing processes and materials.

Minor variations resulting from the production process, including small differences in colour, foil placement, cutting or finishing, may occur and are not considered defects where they do not materially affect the appearance or intended use of the product.

4. Custom-Fit Dust Jackets

Mistyluma dust jackets are produced to fit the specific book dimensions supplied by the customer.

When ordering a custom-fit dust jacket, the customer is responsible for providing accurate:

• book height,

• cover width,

• spine width.

Customers must measure their physical books themselves.

We strongly advise against using dimensions obtained from Amazon, publishers, bookstores, Goodreads or any other online source, as listed measurements may differ from the actual physical dimensions of a particular edition or printing.

Mistyluma is not responsible for fitting problems caused by inaccurate measurements supplied by the customer.

If the measurements provided by the customer are incorrect, replacement or reprinting may require a new order.

If Mistyluma produces a dust jacket incorrectly despite receiving correct measurements from the customer, please contact us so that the issue can be resolved.

5. Made-to-Order Products

Custom-fit dust jackets are made specifically according to measurements supplied by each customer and are therefore personalised / made-to-order products.

Production normally begins after the order and required measurements have been received.

Estimated production times shown on the website are estimates and may vary depending on order volume, printing schedules and other circumstances.

6. Orders

By placing an order, you confirm that:

• the information provided with your order is accurate;

• the delivery address is correct and complete;

• where applicable, the book measurements supplied are correct;

• you have reviewed the product description before purchasing.

We reserve the right to refuse or cancel an order where there is an obvious pricing error, technical error, suspected fraud, inability to fulfil the order, or another legitimate reason.

If we cancel an order after payment has been received, the relevant payment will be refunded.

7. Order Cancellations

Orders may be cancelled within 24 hours of purchase, provided production has not already begun.

Because custom products may enter production shortly after an order is placed, cancellation cannot be guaranteed once production has started.

To request a cancellation, please contact Mistyluma as soon as possible.

8. Returns and Exchanges

Custom-made products

Because custom-fit dust jackets are made according to dimensions supplied by the customer and are produced specifically for that customer's book edition, they are not eligible for return or exchange due to a change of mind, to the extent permitted by applicable law.

This does not affect any statutory rights relating to defective, damaged, incorrectly supplied or non-conforming products.

Non-custom products

Where applicable law grants a right of withdrawal or return for non-custom products, those statutory rights remain unaffected by these Terms.

9. Incorrect Measurements

Customers are responsible for measuring their books carefully before ordering.

Dimensions found online should not be relied upon because different printings, markets and editions of the same title may have different dimensions.

If a dust jacket does not fit because the customer supplied incorrect measurements, Mistyluma is not required to provide a free replacement or refund.

Where possible, we may offer assistance with arranging a replacement at the customer's expense.

10. Damaged or Incorrect Orders

If your order arrives damaged, contains an incorrect item, or appears to have been produced incorrectly, please contact us as soon as possible after delivery.

Please include photographs of:

• the product,

• the packaging,

• the shipping label where relevant,

• and any visible damage or production issue.

We will review the issue and, where appropriate, arrange a replacement, refund, price reduction or other remedy in accordance with applicable consumer law.

11. Shipping

Orders are shipped to destinations currently available at checkout.

Available shipping methods, prices and estimated delivery times are displayed during checkout based on the customer's delivery address.

Delivery estimates are not guaranteed delivery dates.

Once an order has been dispatched, transit times may be affected by circumstances outside our direct control, including customs processing, weather, carrier delays and local delivery conditions.

12. Lost or Delayed Shipments

If a shipment appears significantly delayed, please contact us so that we can investigate the shipment with the carrier.

If a shipment is confirmed as lost, Mistyluma will handle the matter in accordance with applicable consumer law and the circumstances of the shipment, which may include arranging a replacement or refund.

Customers should not submit duplicate carrier claims without first contacting us where the shipment contract was arranged by Mistyluma.

13. Incorrect Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If an order is returned because the customer supplied an incorrect or incomplete address, additional shipping charges may apply before the order can be sent again.

If an address error is noticed before dispatch, please contact us immediately. We cannot guarantee that an address can be changed once an order has been dispatched.

14. Customs, Duties and Import Taxes

International orders may be subject to customs duties, import taxes, VAT, brokerage charges or other fees imposed by the destination country.

Unless these amounts are expressly collected during checkout, such charges are the responsibility of the customer.

Mistyluma does not control customs authorities and cannot guarantee whether or how much a customer may be charged.

Customs processing may also cause delivery delays.

15. Refused or Unclaimed International Shipments

If a shipment is returned to Mistyluma because the customer refuses delivery, fails to pay applicable import charges, or does not collect the shipment, any refund or reshipment will be handled in accordance with applicable law and after taking into account the condition of the returned product and any non-refundable costs.

Custom-made products remain subject to the restrictions applicable to personalised products.

16. Prices and Payments

Prices are displayed in the currency made available to the customer through the Shopify storefront and checkout.

Currency conversions may be performed automatically and exchange rates may change.

Payments are processed through the payment methods displayed at checkout.

An order is not considered confirmed until payment has been successfully authorised.

17. Intellectual Property

All original artwork, illustrations, designs, layouts, photographs, graphics, branding and other original content created by Mistyluma remain the intellectual property of Mistyluma unless expressly stated otherwise.

Purchasing a physical or digital product does not transfer copyright or intellectual property rights to the customer.

Products purchased from Mistyluma are for personal use unless commercial use is expressly authorised in writing.

Customers may not reproduce, scan, copy, redistribute, resell, commercially print, upload, share or otherwise exploit Mistyluma artwork or designs without permission.

18. Fan-Inspired Products

Some products may be inspired by books, fictional worlds, themes or characters.

Mistyluma is an independent business and is not affiliated with, endorsed by, sponsored by or officially connected to authors, publishers, film studios or other rights holders unless explicitly stated otherwise.

Mistyluma does not claim ownership of third-party book titles, character names, trademarks or other intellectual property belonging to their respective owners.

19. Digital Products

Where digital products are offered, no physical item will be shipped unless expressly stated otherwise.

Digital files are intended for personal use only unless a product listing expressly provides a different licence.

Digital products may not be redistributed, resold, shared, uploaded to file-sharing services or commercially reproduced.

Where permitted by applicable law, the right of withdrawal for digital content may cease once the customer has expressly agreed to immediate delivery of the digital content and acknowledged the loss of the right of withdrawal.

Statutory rights relating to defective or non-conforming digital content remain unaffected.

20. Promotions and Discount Codes

Discount codes and promotional offers are subject to any conditions stated at the time of the promotion.

Unless expressly stated otherwise:

• discount codes cannot be exchanged for cash;

• only one discount may be used per order;

• discounts cannot normally be applied retrospectively to completed orders.

We reserve the right to end or modify promotions where reasonably necessary.

21. Website Accuracy

We make reasonable efforts to ensure that product descriptions, prices and other information on the website are accurate.

Occasionally, information may contain typographical errors, inaccuracies or omissions.

We reserve the right to correct errors and update information where necessary.

Nothing in this section limits rights that customers have under mandatory consumer protection law.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the maximum extent permitted by law, Mistyluma is not responsible for indirect losses that were not reasonably foreseeable when the contract was formed.

Mistyluma is not responsible for problems caused by inaccurate information supplied by the customer, including incorrect book measurements or delivery information.

23. Personal Data

Personal information submitted through the store is processed in accordance with our Privacy Policy.

Shopify and third-party payment or shipping providers may process information where necessary to operate the store, process payments and fulfil orders.

24. Third-Party Services

Certain services used by this store may be provided by third parties, including Shopify, payment processors, shipping carriers and other service providers.

Use of these services may also be subject to the respective provider's terms and privacy policies.

25. Prohibited Use

You may not use the website or its content:

• for unlawful purposes;

• to infringe intellectual property rights;

• to transmit malicious code;

• to attempt unauthorised access to the website or connected systems;

• to collect other users' personal information unlawfully;

• or to interfere with the operation or security of the store.

26. Governing Law

These Terms and contracts concluded through the Mistyluma store are governed by Polish law.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of habitual residence where such protections cannot legally be excluded.

27. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our services, business practices or applicable law.

The version applicable to an order is generally the version in force when the order was placed.

28. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
